Welcome to Healium Garden Consultancy & Design.

These Terms and Conditions outline the rules for using our website and engaging our garden Consultancy and design services.

By accessing our website or booking our services, you agree to the terms outlined as per this website.

1. Services Provided

We offer gardening advice  & design, including but not limited to holistic & therapeutic aspects of gardening.

The scope of the services will always be clearly defined in writing (email, proposal or invoice) before work begins.

2. Client Responsibilities

To ensure the best outcome, clients agree to:

*Provide accurate information about their garden, site conditions and their requirements.

*Ensure safe access to the property for consultations and site visits as applicable for physical visits.

*Notify us of any hazards, restrictions, or relevant property issues.

3.Quotes, Fees & Payment

*All quotes are valid for 30 Days unless otherwise stated.

*Payments are due by the date listed on the prepared quote and or invoice.

*Design and consultancy fees are required upfront or in stages, depending on the project or service, including all online services and events.

*Additional services requested after a quote has been accepted may incur extra charges.

4. Cancellations & Rescheduling

We understand plans change.

*If you need to cancel or reschedule a consultation, please provide at least 24 hours notice.

*Late cancellations may incur a fee to cover lost time and travel.

5. Garden Designs & Plantings

 

*All designs and planting plans and advice supplied are for the personal use of the client and may not be copied or shared without permission.

*We cannot guarantee the performance of plants, as this depends on factors outside of our control (weather, soil, maintenance, pests, etc).

​*Any recommendations provided are made in good faith based on the information supplied by the client.

6. Third Party Services & Suppliers

We may recommend third party contractors, suppliers or tradespeople.

*These parties operate independently, and we cannot accept responsibility for their work, products or scheduling.

*Clients are responsible for engaging and contracting any external providers unless otherwise agreed in writing.

7. Website Content

All content on this website - including text, images, designs and branding - is owned by Healium Gardening Consultancy & Design unless stated otherwise.

You may not reproduce or use any content without permission.

8. Privacy

We handle your personal information according to our Privacy Policy. By using our website or services, you consent to the collection and use of your information as described in that policy.

9. Limitation of Liability

While we take care to provide accurate advice and quality designs, we cannot be held liable for: 

*Damages caused by incorrect information by the client

*Delayed access or site conditions that differ from descriptions, especially online consultations where physical access is not possible due to distance of location.

*Plant failure due to weather, lack of maintenance, pests or other natural factors.

*Actions taken by contractors or suppliers not employed by us.

 

Our liability is limited to the value of the service provided only.

 

10. Changes to these terms

We may update these Terms and Conditions from time to time.  Any changes will be posted on this page at our discretion, and continued use of our website or services indicates acceptance of the updated terms.

11. Guidance on healing with Garden herbs and medicinal plants

Some aspects of our garden consultancy services may include general information about:

*Herbs traditionally used for wellness

*Plants traditionally associated with healing

*Folk uses of botanicals for home gardens

This information is intended for educational and horticultural purposes only.

 

12. Not Medical Advice

Any reference to the uses or benefits of herbs or plants:

*Is not medical advice

*must not be relied upon as a diagnosis, treatment or prevention of any condition

*must not replace professional medical guidance

Clients should consult a qualified health professional before using any herb or plant therapeutically, particularly if they have medical conditions, allergies or take medications.

Any information provided about herbal uses, benefits or traditional remedies:

*is NOT medical advice and should not be interpreted as diagnosis, treatment or prevention of any condition

12 Client Responsibility for Herb Use

Clients assume full responsibility for:

*Any decision to use or consume plants or herbal preparations

*Checking for allergies, sensitivities, and interactions

*Ensuring correct plant identification and safe handling.

*We are NOT liable for any adverse effects resulting from the use or misuse of plants.

Clients remain responsible for safe handling and use of all plants and materials recommended for in their garden

*Clients must ensure plants are kept out of reach of children and pets where necessary as some plants may be toxic if consumed or handled incorrectly.

13 Limitation of Liability

To the fullest extent permitted by Law, we are not liable for:

*Plant failure due to weather, maintenance, pests or site conditions

*Injuries or reactions from handling or using plants

*Issues arising from incorrect information supplied by client

*Actions or advice from third party contractors or suppliers

Our liability is limited to the value of the service provided.
